Someone is copying my art and style of art- what can I do about it?

I have some of my art on the internet. My art has a simple, bold graphic design and colorful. Someone wrote me an e-mail and showed me that another person is copying the style of my art. It is not a 100% copy, but an obvious derivation or emulation of it. (I have shown it to several people and they agree.) What can I do to get this person to stop copying my art style? Does copyright law cover this?

The percentage of change in a work of art is a MYTH. Copyright law is a mess but as it was mentionned before, getting in touch might be a good idea. Also, ALWAYS copyright your work. (An artwork is in theory copyrighted the moment it's created, but it always helps to register it to the copyright bureau, especially if you need to bring this to court.)
Reply:If you don't have a copyright, there is not much you can do.As far as copying your style, it is fair game. If your are is copyrighted and someone copies it but does not intend to sell it, so what. When you copy art with the intent to sell and violate the copyright, you can file suit and stop the action. The general style is fair game though.
Reply:I would contact the person and tell them they are infringing on your copyright.
Reply:You can try getting in touch with the person doing it, but that's about it.





Since they aren't copying your work directly copyrights don't apply, and there are no laws preventing copying someone else's style of work. (If there were you couldn't get art movements like op-art in the 60's, because by definition they share stylistic elements)





If you do manage to get in touch with the person copying you, politely tell them why it bothers you and ask them to stop. You do not have the legal power to make them, so your best hope is to be sincere and convincing. But you need to be aware that they may not have ever seen your work and simply have been inspired by the same things you were.
Reply:If they have changed it at least 20% then you have no right to sue. You have copyrights on any material you have created, you don't actually have to apply for them, but the judge has to rule that they have overtly coppied without changing the image at least 20%.





On the bright side, emulation is the sincerest form of flattery, besides, even if they copy you, they still aren't you and that means a lot if you have made a name for yourself. As a matter of fact, if you are the first one to do it, usually copycats actually make your work more popular and valuable.

There is no copyright on style though, just think of the tons of fan art images for every cartoon or anime imaginable. There's not much you can do about it, and my suggestion is not to bother with it. Here's why: if you are a good artist, your style will evolve and refine in time, and copycats will not be able to keep up with that. As long as they're not actually impersonating you by claiming your art as theirs, there is no problem.





Besides, chances are they came up with the style themselves and the similarity is just a coincidence. Perhaps they accuse you of copying too =)


A good way to decide whether they're really copying is to see if they use the same subjects like you (aka only the style is similar, or what the picture represents too?). Also, do they hang out on the same websites? If not, maybe this is just coincidence.





Sadly, all this is very unclear without the actual examples.
